    DOJ reveals Trump's lawyer threw Steve Bannon under the bus

    Steve Bannon filed court documents last week claiming that he can't possibly get a fair trial for his Congressional contempt case because the House Select Committee has put Jan. 6 on the forefront of the public's mind.

    Politico revealed that Donald Trump's lawyer Justin Clark spoke to the FBI, apparently throwing Bannon under the bus.

    At the same time, Bannon claimed Donald Trump decided to "wave" executive privilege in Bannon's case. There was no executive privilege, to begin with, however. It sent political analysts assuming it was all part of another play by Bannon to evade accountability and throw the trial into chaos.

    The Justice Department made their own filing Friday, prior to Bannon's stunt, which was a kind of pre-emptive strike against what they anticipate will be future arguments from Bannon's lawyers.

    The former Trump campaign manager is facing two criminal contempt charges from Congress, one for testimony and another for documents requested by the committee. He's set to appear in court on Monday.

    What Trump lawyer's told the FBI, however, is that Trump had nothing to do with holding Bannon back from speaking to the House Select Committee. Clark effectively threw Bannon and his lawyer under the bus, and refused to cooperate with the Justice Department in good faith.

    In a civil contempt case, Bannon would essentially be put in jail until he agreed to speak. In Bannon's case, however, he is being charged with criminal contempt for refusing to testify, which will still apply whether or not he speaks to Congress and provides the documents requested in the future. So, Bannon claiming he's now willing to cooperate is irrelevant.

    “The Defendant’s timing suggests that the only thing that has really changed since he refused to comply with the subpoena in October 2021 is that he is finally about to face the consequences of his decision to default,” Assistant U.S. Attorney Amanda Vaughn wrote, Politico reported. “All of the above-described circumstances suggest the Defendant’s sudden wish to testify is not a genuine effort to meet his obligations but a last-ditch attempt to avoid accountability.”

    Vaughn said Clark also told DOJ “that the former President’s counsel never asked or was asked to attend the Defendant’s deposition before the Select Committee; that the Defendant’s attorney misrepresented to the Committee what the former President’s counsel had told the Defendant’s attorney; and that the former President’s counsel made clear to the Defendant’s attorney that the letter provided no basis for total noncompliance.”

    “In his effort to create panic, the Defendant also mischaracterizes the information the Government provided relating to Kristin Amerling,” Vaughn wrote.

    Bannon complained that one of the prosecutors involved in his case, Molly Gaston, previously worked with a staffer to the House Select Committee investigating the Jan. 6 attack to overthrow Congress and the 2020 election.

    “As the Government informed the Defendant on July 8, she and Ms. Gaston worked together over a decade ago and were in a book club that Ms. Gaston has not attended in almost two years," wrote Vaughn. "At no point did the Government represent that Ms. Amerling and Ms. Gaston have a close personal relationship, because they do not.”

    First of all you are right Trump cannot invoke executive privilege he's not president. Biden is and already waived executive privilege. And even if Trump was president he can't invoke executive privilege because Bannon does not work for the White House.

    But what is so hilarious now is that if Trump tried to invoke executive privilege for Bannon that could be obstruction of justice. So for all his talking about it Trump never invoked executive privilege and Trump's lawyers just threw Bannon and his lawyers under the bus depriving him of his main defense just before his trial is scheduled to begin next Monday.

    That is just hilarious to me. And plus the DOJ said in court Bannon can go ahead and testify to the J6 committee if he wants to as a last minute stunt but it has no bearing on the charges he is facing. He not only defied the subpoena when it was issued he also has not turned over the records and documents they demanded.

    I have been laughing about this one all day.

    A judge ruled Monday that Steven Bannon's trial for contempt of Congress will not be delayed and will move forward as planned, NBC News reports.

    Bannon was indicted last year for ignoring a subpoena from the Jan. 6 committee, but changed his mind over the weekend and agreed to appear. According to the Justice Department, Bannon's last-minute offer to testify was nothing more than a “last-ditch attempt to avoid accountability.”

    Bannon's lawyer attributed his change of heart to a letter from former President Donald Trump that waived a purported claim of executive privilege. But as NBC News points out, the Justice Department says Bannon's own lawyer told the FBI that Trump “never invoked executive privilege over any particular information or materials" and offered no basis for Bannon's "total noncompliance" with his subpoena.

    "Judge Carl Nichols, who previously ruled that Bannon could not argue that he was not guilty because he was relying upon the advice of his lawyer, ruled Monday that Bannon cannot present evidence that he relied upon old opinions from the Justice Department's Office of Legal Counsel (OLC) regarding executive privilege either," reports NBC News.

    Bannon was among dozens of people called to testify on last year's assault on the Capitol aimed at shutting down Congress over former president Donald Trump's baseless claims that Joe Biden won the 2020 election due to voter fraud.

    Investigators believe Bannon and other Trump advisors could have information on links between the White House and the mob that invaded the Capitol on the day it was due to certify Biden as winner.

    Although he was not a White House employee or official Trump aide, Bannon's attorneys had previously claimed he was protected by presidential executive privilege and did not have to cooperate with the committee.

    According to the letter explaining his about-face, Bannon told the House Select Committee that "circumstances have now changed."


    "President Trump has decided that it would be in the best interests of the American people to waive executive privilege for Stephen K. Bannon, to allow Mr. Bannon to comply with the subpoena issued by your Committee."

    In November last year, Bannon turned himself in to the FBI to face charges of contempt of Congress after refusing to testify on the January 6 Capitol assault.

    "I'm never going to back down," he told reporters at the time after appearing before a judge to hear the charges.

    "We're going on the offense on this. And stand by," he said, repeating the phrase Trump used during the election in 2020 to encourage supporters of a far-right militia group.

    Bannon, 68, was indicted by a grand jury with two misdemeanor counts of contempt, each one carrying a penalty of one month to one year in jail, and a fine of up to $100,000.

    The attack, which left five people dead, succeeded in delaying the joint House-Senate election certification session for several hours.

    On Monday's edition of MSNBC's "The Beat," former Solicitor General Neal Katyal broke down the significance of Trump associate Steve Bannon's push to cooperate with the House Select Committee investigating the January 6 attack on the U.S. Capitol.

    For the last year, Bannon has refused to cooperate or respond to subpoenas in any way, resulting in criminal contempt of Congress charges.

    "Neal, your reaction to Mr. Bannon's position, what with its legal deficiencies we'll get into later with our conversation, but what does it say about aspects of the system potentially working?" asked anchor Ari Melber.

    "I do think, Ari, it was an interesting reversal from Steve Bannon," said Katyal. "This is the one time that Steve Bannon has wanted to check his privilege, and it turns out he doesn't have any. This is a guy who wasted three chances to do the right thing. He could have volunteered to testify. He could have testified after being subpoenaed or after the criminal referral. And we're now a week before his criminal trial, Ari, as you were saying, and now all of a sudden he says he wants to do his duty. And I don't know what in the world Steve Bannon must have said to Donald Trump to allow him to waive this privilege that he's never even had in the first place, but I doubt it was an appeal to the greater good."

    Katyal proceeded to elaborate on his view of Bannon's mental calculation.

    "I agree there's a fear component on the part of Bannon," said Katyal. "He's got to, particularly after the judge's ruling today. But this has always felt to me like some sort of last-ditch attempt by Bannon to get in the good graces of the judge and jury for his criminal trial and also to perhaps try to turn the PR narrative, in which the House January 6th Committee's been so successful on, and trying to get a Trump person to testify on live TV."

    This is the difference between the Big Lie and the Jan6 insurrection. The poor Trumpers could never find a fraudulent ballot, or a person who cast a fraudulent ballot.
    There's no problem finding people who were involved in the Jan6 insurrection and evidence of what they did.

    The real problem for Trump and Trumpettes is at this point a lot of people have testified and pointed the finger at Trump, while all the people who could testify that Trump did not violate his oath of office or any applicable laws, have refused to testify, or pled the 5th amendment to avoid answering questions.

    It's tough to mount a legal defense when all the witnesses for the defense say, "I decline to testify because it may tend to incriminate me."

    The problem faced by the Jan6 crowd is the last step of the plan was pardons for everybody. Most criminals make "not getting caught" a factor in all plans. They weren't concerned with wearing masks and get away cars, because a grateful President Trump would be treating them to ice cream with sprinkles on Jan7.

    Now, there is a mad scramble to avoid prison for a lot of people, so squealing comes easy. The best part of this opera is it's like listening to four year olds with law degrees. First, it wasn't insurrection, then maybe it was but some kind of false flag operation(antifa did it), and now we hear the cries of anguish when they have to face the fact that, "Yes, it was all a crime, and worse, it was all for nothing." Imagine the plight of an Oath Keeper who kept his end of the bargain and now watches the Jan6 hearings. He attacked the Capital and stopped the election certification. It was bad enough that Trump did not come to the Capital with them, as he said he would do. The hearings revealed that Trump made absolutely no plans to do so. He's been President for 4 years. He can't step outside the White House without a plan in place. Trump thought he could just say, "Let's go to the Capital," and it would happen. Oath Keepers spent a lot of time and effort, with great personal risk and planned their actions of Jan6.

    Trump made no plans and hung them all out to dry. There's going to be a lot of squealing.

    You are so right. First because if the attempted coup had succeeded then there would be no need for pardons. Trump would be dictator for life and claimed his domestic terrorists were patriots and heroes.

    But prior to J6 and immediately after Trump had indicated he would pardon everyone. J6 defendants have said that and also why members of Trump's inner circle and Republicans in Congress were asking for them. But then Trump was warned if he tried to pardon those involved it would actually prove him guilty of obstruction of justice so he had to back off.

    Leaving many so disappointed they have now agreed to cooperate with federal prosecutors.

    Conservative podcaster Steve Bannon lashed out at members of the House Select Committee on Jan. 6 because he hasn't been invited to testify after first refusing and being charged with contempt of Congress.

    On his daily War Room: Pandemic program, Bannon argued that MAGA supporters should pray for their "enemies."

    "Pray for our enemies," he said. "Because we're going medieval on these people. We're going to savage our enemies. So pray for them. Who needs prayers? Not MAGA, not War Room, and certainly not Steven K. Bannon but I'll take everything I can get."

    Bannon laid out his demands for testifying at a Jan. 6 hearing.

    "Here's what I need," he asserted. "Give me a date, a time, a room number, a microphone and a Holy Bible that I can take the oath on. Boom! Deliver that and we'll see how good you are little Jamie Raskin and Liz Cheney and all of it."

    "Serve it up," the right-wing host repeated. "Here's my request: date, time, room number, a microphone that works and a Holy Bible to take the oath on. OK, show me what you got."

    Bannon accused the committee of "taking these interviews and cutting them up."

    "As Trump says, no games," he ranted. "We're not playing games. We're beyond games."

    "We're taking down -- we're killing the Biden administration in the crib and we're glad," Bannon concluded.

    Trump recently revoked his executive privilege claim that Bannon said prevented him from testifying. But Bannon has not yet been invited to speak to the committee and his contempt of Congress trial is set to proceed as scheduled.

    The logic of the despicable thought process is hard to follow.

    See, this Trump fellow lost the election only he isn't a good loser so he plotted with all these extremist groups to overthrow the government and be installed as dictator for life.
    Now, to do this Trump had to use some kind of secret code words, cause when you look at what trump tweeted and said before January 6, he used words like "Go in peace" and "I love Pennsylvania avenue" and "We're going to the capitol". Only sometimes he said stuff like "we're going to fight like hell" and "We're going to stop the steal" so no one knows what the code words are except the extremist groups.

    Anyway all the extremist groups understood trump and they loaded up and they had guns and bombs and flags and a hanging scaffold and they were going to by GOD take the capital and uncertify the election and then Trump would go back to the oval office and be dictator for life.
    And just to throw everyone off he thought maybe the National Guard Troops should be called in, but he never told anyone this and anyway the capital police asked for the guard but they were denied even though everyone was pretty sure there was going to be trouble, but, you know, "optics"and so trump was happy there wasn't going to be any national guard to, you know, fight with his extremist groups.

    And on January 6 all the groups were there and listened to Trumps incendiary speech and then they marched over to the capital to hang Pence even though the whole plan rested with Pence not certifying the election, and anyway even if they'd dragged Pence out to the scaffolding it was clear that it would have collapsed as soon as they put Pence up there and it was even so short Pence would have ended up just standing there anyway, but that was OK cause they needed Pence to uncertify the election before they hung him.

    And Trump was going to walk over with them but his secret service people wouldn't take him and that pissed him off and he tried to steal the limo but they stopped him and took him back to the oval office and trump pouted about that.
    Meanwhile in the capital the crowd broke into the capital and rampaged about and stole Nancy's beer and her lectern but they never did find Pence or, for that matter anyone else of value and trump finally told them he loved them and they should all go home. Which, you know, they all did cause they didn't really have much of a plan besides grabbing the capital and pence and maybe Nancy and then barricading the doors and ............. well, you know ...........then they would win. But none of that mattered because they knew trump would pardon them if it came to that and he promised, only trump didn't pardon them because it would mean trump was guilty of ................ something and besides, it's trump.

    But over at the oval office trump's plan was in tatters and even his kids hadn't been read in on the plan but some of the staff did know the plan but they wouldn't tell anyone except that if it was staff that didn't know the plan they would tell anyone who asked but in any case Trump's kids didn't know about it cause when they heard about it they were divided on what the best course would be, except, you know, to have the rioters traitors go ahead and just go home and the rest of the staff was divided and almost got into a fist fight over it all because some of them were true patriots and others were only true patriots, it depended on who you asked about that.

    So, biden is president and Nancy called up her star chamber minions to investigate all this even though the DOJ and FBI started investigating on January 7, and since then the DOJ and FBI have identified just about everyone who did anything on January 6 and they've been arrested and charged and some of them have plead guilty or been found guilty and they're getting sent to jail, a lot of them, but some haven't been tried yet but they might still be in jail even though that might be illegal but it's trumps traitors so who gives a shit, and besides, nancy's star chamber is having closed door hearings and testimony from secret people and as soon as they testify their testimony is sealed except some of it is good so they're leaking that and even when they get prime time coverage are having them come back to tell again what they heard and saw. Or, at least what they think they heard and saw.

    And as soon as they testify they have to go into hiding because trump's extremists are still out there and they're making threats like "We hope you get cancer and die" and "You cocksucker we know where you live" and "people are very interested in your testimony and we know you'll do it right" and oh yeah, that's also all the justification needed to make the star chamber people go all secret police and not tell anyone who will be testifying or what they testified to or what documents there are cause, danger, but wait, here we can share this part with you about trump being pissed at the limo driver, and the staff was going to go fisticuffs before the day was over, but that doesn't put anyone in danger so we can tell you that part but not the other parts but trust us, trump is a scoundrel and we have the proof!

    But the DOJ/FBI and deplorables are getting upset because the star chamber minions won't tell what they've got or share much of it until they're done getting all the testimony and documents and stuff, and they don't care what the FBI/DOJ has or has done, cause you know it's CONGRESS and they're in charge, not the FBI/DOJ and for damn sure they won't cooperate with the deplorables cause, trump.

    Oh, almost forgot; anyone who voted for trump, or won't agree that he's a scoundrel is a scoundrel themselves and should be hung. And we still have the scaffolding that trumps extremist groups left behind, so you better start toeing the line.
